These Terms govern use of our Site and booking/receipt of our local and long-distance residential and commercial moving, packing, labor-only, and related services (the “Services”). By accessing the Site, requesting a quote, placing a booking, paying a deposit, or receiving Services, you (“Customer,” “you,” “your”) accept these Terms.


Who We Are & Regulatory Status (California)

5 Points Moving is a professional household goods mover serving Los Angeles and Southern California. We operate in compliance with applicable California intrastate household-goods regulations, local parking and building rules, and relevant federal guidelines for interstate shipments where applicable. Where California law prescribes consumer disclosures (e.g., estimates, valuation, itemized invoices, “double drive time”), we follow those requirements. Nothing in these Terms waives any non-waivable rights under California law.


Quotes, Rates & “Double Drive Time”

2.1 Estimates

Online or phone quotes are non-binding estimates based on the information you provide (inventory, stairs, elevator, long carries, parking distance, packing needs, special handling, etc.). Final charges reflect actual labor, materials, travel, access conditions, and any add-ons requested on the day of service.

2.2 Hourly Moves (Local)

  • Minimum: [e.g., 3-hour minimum labor] + standard travel charge.
  • Billing increment: [e.g., 15-minute increments] after the minimum.
  • Travel/Service fees: may include fuel, tolls, parking/permits.

California “Double Drive Time.” For intrastate local moves where time-based billing applies, the driving time between origin and destination is charged at twice the actual drive time as required by California law. This compensates for unbillable return travel and is standard throughout California.

2.3 Flat-Rate/Binding Moves

A written flat rate binds only to the documented inventory, addresses, access conditions, and services in the agreement. Changes (extra items, repacking, additional stops, delays outside our control) allow us to issue a revised price or revert to hourly billing with your consent.

2.4 Materials & Special Handling

Boxes, tape, shrink-wrap, wardrobe boxes, mattress bags, TV crates, crating, long carries, stair/hoist work, and bulky/oversize items (e.g., safes, pianos, pool tables) are billed per our current schedule.


Scheduling, Deposits, and Cancellations

3.1 Booking Window

Start times are scheduled in arrival windows (e.g., 8–10 AM). Traffic, weather, and earlier jobs can affect arrival. We update you promptly and work in good faith to meet your window.

3.2 Deposits

A deposit may be required to hold your date/crew/truck and is applied to final charges. Deposits are refundable if you cancel ≥72 hours before the scheduled window; otherwise deposits may be forfeited, except where California law provides otherwise.

3.3 Rescheduling/Cancellation

You may reschedule subject to availability. Same-day cancellations, no-access situations, or Customer no-shows may incur a minimum-hour charge plus travel and any parking/permit costs actually incurred.


Customer Responsibilities (Building, Parking, Packing)

  • Access & Permits: Secure elevator reservations, loading dock access, certificates of insurance (COIs), and any street/parking permits.
  • Packing Readiness: Unless you hired us to pack, have items boxed, sealed, and labeled.
  • Prohibited Items: No hazardous materials, live plants/animals, firearms/ammunition, or illegal items.
  • Presence/Adult Representative: You or your agent must be present to direct placement and sign documents.

Valuation Coverage (Not Insurance) & Claims

5.1 Released Value (Default)

Shipments move under Released Value protection at $0.60 per pound per article. Example: a 50-lb item = $30 maximum recovery if lost/damaged.

5.2 Full Value Protection (Optional)

You may purchase Full Value Protection (FVP) at additional cost before the move. If an item is lost/damaged, our obligation—at our option—is to repair, replace, or pay current market value, subject to deductibles and exclusions.

5.3 Exclusions & Handling Limits

Items like particle-board furniture, pre-damaged or fragile goods, and contents packed by owner (“PBO”) may be excluded from carrier liability.

5.4 Notice of Claim

Submit written claims to 5pointsmoving@gmail.com with photos and signed delivery documents. Keep packing for inspection.


Payment Terms

  • When Due: All charges are due at delivery unless otherwise agreed in writing.
  • Methods: Cashless preferred (major cards); card fees may apply if disclosed.
  • Unpaid Balances: Past-due amounts accrue 1.5% per month or the legal maximum.
  • Disputes: Notify us within 7 days of delivery with sufficient detail.

Delays, Weather & Force Majeure

We are not liable for delays caused by events beyond our control (e.g., severe weather, strikes, road closures). Services will resume as soon as practicable.


Limitation of Liability

  • 8.1 Scope: Our liability is limited to your selected valuation option.
  • 8.2 Indirect Damages: We are not liable for incidental or consequential damages.
  • 8.3 Cap: Liability is limited to Released Value recovery or $500 total for non-cargo claims.

Site Use; Intellectual Property; User Content

The Site, content, and software are owned by or licensed to 5 Points Moving. You may not copy or commercially exploit the Site. Submitting User Content grants us a non-exclusive, worldwide, royalty-free license to use it for marketing, subject to privacy rights.


Safety & Professional Conduct

Our crews will not perform unsafe work or violate building rules/laws. We may pause or refuse services until safety conditions are met.


Termination/Refusal of Service

We may suspend or terminate service for cause (e.g., unsafe conditions, abusive behavior, nonpayment). You remain responsible for charges incurred.


Dispute Resolution; Arbitration; Venue

12.1 Informal Resolution

Email 5pointsmoving@gmail.com with “Dispute” in the subject and your order number.

12.2 Arbitration/Class Waiver

Except for small-claims or temporary injunctive relief, disputes are subject to binding arbitration in Los Angeles County under AAA or JAMS Consumer Rules.

12.3 Opt-Out

You may opt out within 30 days by mailing a signed notice to: 5 Points Moving, LLC, Attn: Legal – Arbitration Opt-Out, Los Angeles, CA.


Privacy

Our Privacy Policy explains how we collect, use, and share personal information. It is incorporated into these Terms.


Changes to These Terms

We may update these Terms from time to time. The Effective Date shows the last update. Material changes will be posted on the Site.


Miscellaneous

  • Entire Agreement: These Terms, your signed estimate/contract, and the Privacy Policy are the full agreement.
  • Severability: If any provision is unenforceable, the rest remains valid.
  • Assignment: You may not assign without our consent; we may assign to an affiliate or successor.
  • No Waiver: Failure to enforce a right is not a waiver.
  • Notices: We may notify by email or text; you may contact us by email or mail to our Los Angeles address.
